Purpose of consultancy

On June 21, 2019, the International Labour Organization’s International Labour
Conference (ILC) adopted the Violence and Harassment Convention No.190 and
Recommendation No.206.The ILC further adopted the Centenary Declaration on the
Future of Work, expressing a clear commitment to a world of work free from
violence and harassment.
The adoption of the Convention and recommendation was very significant; it is
the first-ever international standard aimed at ending violence and harassment
in the world of work and that the right to a world of work free from violence
and harassment has been articulated in an international treaty. The adoption
of this first International Labour Standard at the beginning of the second
Century of the ILO is a historic opportunity and a call for action to shape a
future of work based on dignity and respect in the workplace.
Zambia was among the 439 countries that voted for the adoption of the
Convention concerning the elimination of violence and harassment in the world
of work (No.190) and its accompanying recommendation (No.206) on 21st June
2019 at the International Labour Conference in Geneva, Switzerland. Zambia
also made commitments to the ratification, domestication and implementation of
articles of the convention and its recommendation, later in June 2020, the
ratification and implementation roadmap for C190 and its accompanying
recommendation No. 2016 was developed by the employers, workers and government
of Zambia. However, there has been slow pace in terms of ratification and
implementation of C190 in the country considering the fact that it’s now 2
years from the time the convention was adopted. The gap analysis is a key
input into the outputs and outcomes for the ratification and implementation
roadmap for C190. There is no information and evidence on where we are coming
from (what has been done), where we are (what is being done) and where we
ought to be in terms of having a just and sustained world of work free from
violence and harassment. There may also be variances and meeting points
between Zambian Laws and the International Labour Standards (C190 and
Recommendation 206) that could have contributed to the slow pace in
ratification and implementation.

The C190 ratification implementation roadmap recognizes the power of research
(gap analysis) to educate, inform and influence various key stakeholders in
the country with evidence based information and data, thereby increasing
awareness to the public by unpacking the information and knowledge gaps that
could exist. Furthermore, the findings of the gap analysis will direct public
interest towards topical issues, thereby generating interest from decision-
makers to address issues that are in the lime light.

As part of the C190 implementation and ratification roadmap to be implemented,
a gap analysis is identified as an opportunity to address the difference and
similarity between C190 and the various laws of the republic of Zambia on
Gender, Violence and Harassment in the world of work and that of articles of
C190 and its recommendation. The ratification roadmap seeks to conduct a gap
analysis on the Zambian laws, C190 and its accompanying recommendation.
Through the gap analysis, it is envisaged that the differences and
similarities between various Zambian Laws and C190 will be identified,
presented at the National Dialogue to key stakeholders.
The objective of the consultancy is to conduct a gap analysis of Zambian Law
and practice in respect of Convention No.190 to establish Zambia’s readiness
to ratify it.

Scope of work(Description of services, activities, or outputs)

The period for the gap analysis is 20 days desk review research and key
informants interviews to get information required for the gap analysis. The
materials to be reviewed will be the Zambian Constitution, The Penal Code, The
Anti-Gender Based Violence (GBV) Act of 2011 of the laws of Zambia, the Gender
and Equality Act, National Gender Policy, Cabinet Circulars and the
International Labour Standards (C190 and Recommendation No 206). The
consultant will work with the International Labour Office (ILO), Cabinet,
Ministry of Justice, Ministry of Home Affairs, Ministry of Labour and Social
Security (MLSS), Zambian Law Development Commission, Ministry of Gender,
Office of the Vice President (OVP), Zambia Congress of Trade Unions (ZCTU),
Zambia Federation of Employers (ZFE) and the Non-Governmental Organisations
Coordinating Council (NGOCC). The consultant will deliver (conduct research)
the gap analysis and finalize the submission of findings of the gap analysis,
research programme and present findings at the National Dialogue (dates to be
communicated) and the ILO. In conducting a gap analysis of Zambian law and
practice in respect of convention C190, the consultant is expected to do the
following;

1\. To review existing relevant legislation and regulations
2\. To examine the effective practice, i.e implementation of existing
legislation and regulations in the country.
3\. To identify whether and how provisions of Convention No C190 are reflected
by existing laws, regulations and practice
4\. To identify provisions of Convention No 190 that would require changes to
law and practice in the country for compliance with the convention
5\. Recommend the necessary changes, which need to be made to law and practice
to ensure compliance with convention No 190.
6\. Present the Gap analysis during the National dialogue

Deliverables

1\. Submission of a programme for the GAP Analysis detailing the schedule of
activities, proposed timelines of the assignment and responsible persons
2\. Submission of a Draft Report of the GAP Analysis
3\. The consultant will also submit the final report of the Gap Analysis which
will be compiled using information from the desk review and key informants.
4\. The final report should include a matrix showing the extent to which law
or practice in Zambia already meets the conventions requirements.
5\. The final report should also include the extent to which national law or
practice can be adjusted and the provisions of the Convention No 190 for which
such adjustment will be difficult in Cases of finding Gaps and Inconsistencies
6\. The consultant will deliver a report of no more than 20,000 words
containing the consultants descriptions and recommendations, in English which
shall be submitted electronically in MS Word format

Duration and working schedule Twenty (20) working days (1st June 2021 – 29th
June 2021).

1\. Draft Gap Analysis findings, List of Zambian Laws Consulted.
2\. Final Gap Analysis Report

Monitoring and progress control, including reporting requirements, periodicity
format and deadline 1.Final report with observations and recommendations from
the consultant regarding the gap analysis and actions that can be taken to
enhance the ratification and implementation of Convention No. 190 and
generating interest from national decision/policy makers, lawmakers and social
partners will be shared with at the end of the consultancy (trainings).

Supervisory arrangements

The consultant will work under the overall supervision of the Director of the
ILO-Country Office for Zambia, Malawi and Mozambique (CO-Lusaka), and under
the direct supervision of the Gender Specialist DWT Pretoria, National Project
Officer, Senior Programme Assistant and Communications Officer –at ILO Co-
Lusaka

Required expertise, qualifications and competencies, including language
requirements

> The consultant must have a minimum of a Master’s Degree in related field, such as law, humanities, social sciences, criminology or a relevant field.
> The consultant should have extensive professional experience working in the field of gender, gender based violence, women at work.
> The consultant must have experience that demonstrate the knowledge that the consultant is relevant to the assignment to be undertaken, including track-record publications
> The consultant must have proven ability to work with Public authorities Government and with the ILO constituents is a necessity
> The consultant must have excellent command (written and oral) of English and knowledge of major local languages is an added advantage.
