ActionAid Zambia

ActionAid Zambia (AAZ) is a member of the ActionAid International Federation
and its vision is to see a just and poverty-free Zambia in which every person
enjoys the right to a life of dignity. In trying to realize its vision, AAZ
works with poor and excluded people to end poverty and injustice.

1. Background
*> As of 2020, Zambia’s population was about 17,426,623. Of this number, over
55% of the population are women, despite being the majority, Men in Zambia
still have more access to, control over, and ownership of land in comparison
to women. The few women who access, control, and own land still face many
challenges. This is more so when the land is controlled by traditional leaders
who apply customary practices.The shift towards women owning land follows
pressure from civil society, churches, and other stakeholders. The policy
entitles women to be allocated 30% of all advertised Council or state land.
Women can then compete with men for the remaining 70%. The question is now
whether the policy is truly benefiting women.

There are two types of land in Zambia state and customary. The latter covers
about six percent of the total land area. Customary land is held under customs
and traditions governing land use and ownership.

Despite being a signatory, Zambia does not fully adhere to some international
rights treaties such as the SADC Gender Protocol. Ninety percent (90%) of
Zambian land falls under traditional designation and only 10 percent under
state. This means that the vast land that women should benefit from is still
controlled by traditional leaders who maintain cultural practices that bar
women from acquiring land.

However, it is well noted that access to land and ownership is essential for
economic productivity and sustainable livelihoods. Which is a key in
alleviating poverty among women who are the majority in Zambia living in
abject poverty, engaged in small to medium scale enterprises and business, and
are the key caregivers not only to their biological children but mostly to the
extended family at large.

It is with the shared background that ActionAid Zambia, wishes to engage a
consultant to “Analyse Policy and Legal Frameworks on Women and Access to
Natural Resources & Land Ownership’’.

2. General Objective
*> Analyse Policy and Legal Frameworks on Women and Access to Natural
Resources & Land Ownership.

3. Specific Objectives
*> These include the following

> Highlight key provisions in the policy and legal frameworks that promote women access to natural resources and land ownership.
> Highlight gaps and inconsistencies in the provisions on women’s access to natural resources and land ownership in identified policy and legal frameworks.
> Provide recommendations on all gaps and inconsistencies identified in the policy and legal frameworks.
> Identify practices that hinder women’s access to natural resources and land ownership in each of the identified wards in Nakonde, Mpulungu, and Sesheke.
4. Process
*> The Consultant will be expected to undertake desk review of the policy and
legal frameworks and engage relevant Ministries such as the Ministry of gender
(MOG), the Ministry of Lands and Natural resources, the Ministry of Chiefs,
and Traditional Affairs, the Ministry of Agriculture, and Livestock, and the
Ministry of Forestry. Additionally, the Consultant will be expected to engage
with different stakeholders including women in the identified Wards.

5. Deliverables
> First draft report submitted, and validation meeting held.
> Final report submitted (detailed report and summarized report/policy brief)
6. Time schedule*>
The consultancy is expected to be undertaken from 5th May 2021 to 15th May
2021. Bid Submission*>
Prospective consultants should submit the following.

> Not more than 4 pages technical proposal highlighting how they intend to undertake the task at hand.
> Not more than 2 pages financial proposal
> A Curriculum Vitae (CV)
> With samples of similar works done (1 or 2 samples electronically submitted).
7. Qualifications and Competencies
*> The consultant should have the following qualifications

> Degree or master’s degree in Development Studies, Gender studies, land or Natural resource management, and environmental conservation.
> Demonstrated knowledge of policy development and analysis highly recommended.
> Knowledge of Zambia Gender policies or laws that speak to women, gender, Natural resources, and Land Act.
> Sound relationship with key ministries and stakeholders.
> Demonstrated ability to prepare deliverables of good quality on time.
> Experience in undertaking similar assignments with reputable institutions.
